Welcome to Pawtment. These Terms of Service ("Terms") govern your access to and use of the Pawtment website (pawtment.com) and any related services we provide (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Who We Are

Pawtment is an online retailer of curated pet products designed for apartment dwellers, renters, and small-space pet owners. References to "Pawtment," "we," "us," or "our" in these Terms refer to the operators of pawtment.com. References to "you" or "your" refer to you, the user or customer.

2. Eligibility

To use our Services, you must:

Be at least 18 years old, or have permission from a parent or legal guardian
Provide accurate, current, and complete information during the checkout process
Have the legal authority to enter into a binding agreement

If you're using our Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

You may browse Pawtment without creating an account, but certain features (order tracking, saved addresses, order history) require account registration.

When you create an account, you agree to:

Provide accurate and complete information
Keep your login credentials secure and confidential
Notify us immediately at info@pawtment.com if you suspect unauthorized access to your account
Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms, are used for fraudulent activity, or pose a security risk.

4. Orders and Purchases

Placing an order. When you place an order through Pawtment, you're making an offer to purchase the items in your cart at the prices listed at checkout. Your order is not confirmed until we send you an order confirmation email.

Order acceptance. We reserve the right to refuse, cancel, or limit any order at our discretion, including for reasons such as:

Suspected fraudulent activity
Pricing or product description errors
Inventory unavailability
Shipping restrictions to your location
Suspected resale or bulk-purchase abuse

If we cancel an order after payment has been processed, you'll receive a full refund to your original payment method.

Pricing. All prices are listed in U.S. dollars and do not include applicable taxes or shipping costs, which are calculated at checkout. We reserve the right to change prices at any time, but changes will not affect orders that have already been confirmed.

Pricing errors. Occasionally, a product may be listed at an incorrect price due to typographical, technical, or supplier errors. If we discover a pricing error on an item in your order, we'll notify you before charging your payment method and give you the option to confirm the order at the correct price or cancel.

5. Payment

We accept payment through the methods listed at checkout, including major credit cards, Apple Pay, Google Pay, and Shop Pay. Payments are processed securely through Shopify's PCI-compliant checkout system. We do not store your full payment information on our servers.

By submitting payment, you represent that you are authorized to use the payment method provided and that all payment information is accurate.

If your payment is declined or reversed for any reason, we reserve the right to cancel your order and pursue collection of any outstanding amounts.

6. Shipping and Delivery

Shipping terms, processing times, and delivery estimates are governed by our Shipping Policy, which is incorporated into these Terms by reference.

Risk of loss. Once an order is delivered to the carrier, risk of loss and title for the items pass to you. Pawtment is not responsible for items lost, stolen, or damaged after the carrier confirms delivery.

7. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. Please review that policy carefully before making a purchase.

8. Product Information and Disclaimers

We work hard to display accurate product information, including descriptions, photos, dimensions, and materials. However:

Colors and appearance may vary slightly between what's shown on your screen and the actual product, due to monitor settings, lighting, and manufacturing variation.
Dimensions and weights are approximate.
Product availability is subject to change without notice.
Product specifications may be updated by manufacturers; we make every effort to keep listings current but cannot guarantee real-time accuracy.

Pet safety disclaimer. Pawtment curates products designed for pet use, but no pet product is indestructible or universally safe. You are responsible for:

Supervising your pet during product use
Following all manufacturer instructions and warnings
Discontinuing use of any product that becomes damaged, broken, or worn
Selecting products appropriate for your pet's size, breed, age, and chewing habits

Pawtment is not liable for injury, illness, property damage, or harm caused by improper use, misuse, or failure to supervise pets during product use.

9. User Conduct

When using our Services, you agree not to:

Use the Services for any unlawful purpose
Submit false, misleading, or fraudulent information
Attempt to access another user's account or any restricted areas of our systems
Use automated tools (bots, scrapers, crawlers) to access, copy, or interfere with our Services
Resell products purchased from Pawtment without our written authorization
Reverse-engineer, modify, or create derivative works of our website or content
Interfere with or disrupt the security or functionality of our Services

We reserve the right to investigate suspected violations and take appropriate action, including suspending or terminating your account and pursuing legal remedies.

10. Intellectual Property

All content on pawtment.com — including the Pawtment name, logo, product photography, written content, design elements, and branding — is the property of Pawtment or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, republish, modify, or use any content from our Services for commercial purposes without our prior written consent.

You may share links to our pages on social media and reference our brand in personal, non-commercial contexts.

If you believe any content on our site infringes on your intellectual property rights, please contact us at info@pawtment.com.

11. User-Generated Content

If you submit content to Pawtment — including product reviews, photos, comments, social media tags, or other materials — you grant Pawtment a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display that content in connection with our Services and marketing.

You represent and warrant that:

You own or have the necessary rights to the content you submit
Your content does not violate any third-party rights (copyright, trademark, privacy, publicity)
Your content is truthful and not misleading
Your content does not contain unlawful, defamatory, obscene, or harmful material

We reserve the right to remove, edit, or refuse any user-submitted content at our discretion.

12. Reviews and Testimonials

Product reviews submitted to Pawtment must be honest, based on actual product use, and reflect your genuine experience. We do not edit reviews to remove negative feedback, but we reserve the right to remove reviews that:

Contain profanity, hate speech, or personal attacks
Promote competing products or include external links
Are submitted by individuals who have not purchased the product
Violate any applicable laws or regulations

13. Third-Party Links and Services

Our Services may contain links to third-party websites, services, or content (including social media platforms, payment processors, and shipping carriers). We do not control, endorse, or assume responsibility for third-party content or practices.

Your interactions with third-party services are governed by those parties' terms and policies. Review them carefully.

14. Disclaimer of Warranties

OUR SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, Pawtment disclaims all warranties, including but not limited to:

Implied warranties of merchantability
Implied warranties of fitness for a particular purpose
Warranties of non-infringement
Warranties that our Services will be uninterrupted, error-free, secure, or virus-free

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions may not apply to you, and you may have additional rights under local law.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PAWTMENT, ITS OWNERS, EMPLOYEES, AFFILIATES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO:

Your use of (or inability to use) our Services
Any product purchased through our Services
Unauthorized access to your account or data
Any third-party content, conduct, or services

Our total liability for any claim arising out of these Terms or your use of our Services will not exceed the amount you paid to Pawtment in the 12 months preceding the claim, or $100 USD — whichever is greater.

Some jurisdictions do not allow limitations on certain damages. In those jurisdictions, the above limitations may not apply to the extent prohibited by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Pawtment, its owners, employees, affiliates, and partners from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of:

Your violation of these Terms
Your violation of any law or third-party right
Your use or misuse of any product purchased from Pawtment
Any content you submit to our Services

17. Termination

We may suspend or terminate your access to our Services at any time, without notice, for any reason — including violation of these Terms.

You may stop using our Services at any time. If you have an account, you can request account deletion by emailing info@pawtment.com.

Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution) will remain in effect after termination.

18. Modifications to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Significant changes will be communicated via email (for registered users) or a notice on our homepage.

Your continued use of our Services after changes become effective constitutes acceptance of the updated Terms. If you don't agree to updated Terms, stop using our Services.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Louisiana, without regard to its conflict of laws principles.

Informal resolution. Before filing any formal claim, you agree to first contact us at info@pawtment.com and attempt to resolve the dispute informally. Most issues can be resolved through direct communication, and we genuinely want to make things right.

Formal disputes. If we can't resolve a dispute informally within 60 days, any legal action must be brought in the state or federal courts located in Louisiana, and you consent to the personal jurisdiction of those courts.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Pawtment regarding your use of our Services and supersede any prior agreements.
